无保证除本条款中明确规定或法律要求实行不同的标准外，对于因以下原因引起的或与之相关的任何损失、损害、伤害或任何直接、间接、特殊、附带性、惩戒性或后果性损害（包括但不限于利润损失或能源损失），鸿宝概不负责：使用或无法使用产品或服务，或产品或服务的任何故障；第三方合作伙伴的作为或不作为，包括但不限于第三方内容、访问或使用服务；电子或机械设备故障或通信线路、电话故障或其他互连问题；漏洞、错误、病毒、木马、配置问题，或计算机软硬件不兼容；互联网连接失败或无法使用；互联网服务提供商的问题；中间计算机或通信网络或设施的问题或延迟；数据传输设施的问题；或您因超出我们控制范围的原因而遇到的任何其他问题。对于站点或服务中的错误（包括服务数据测量不准或缺失），或者服务未检测出产品的任何故障或检测错误，鸿宝概不负责。除任何适用协议中另有明确规定外，您理解并同意，您使用服务是由您自担风险，并且服务以及站点中包含的或可从站点访问的所有信息、产品和其他内容（包括第三方信息、输出、产品和内容）均按“原样”、“现状”和“可用性”提供。您承认，除站点或任何适用协议中另有规定外，我们并不保证服务连续、及时、安全或无错。在法律允许的最大范围内，我们否认与服务以及站点中包含的或可从站点访问的所有信息、产品和其他内容（包括第三方信息、产品和内容）有关的一切形式的陈述、保证和条件（无论是明示、默示、法定还是其他形式，包括但不限于有关适销性、适合特定目的、所有权及不侵犯所有权的保证）。前述免责声明中不存在对您的任何默示许可。 (8) 天向您发出书面通知，但是，因您停止使用产品、您未履行支付义务或其他产品相关义务、违反本条款或我们向您提供的其他条款或您所购产品的卖方（包括任何支付协议）等原因而终止站点或服务的情况除外，在该等情况下，不会发出通知。各方在终止之日前产生的责任和义务，就各方面而言，应在本条款终止后继续有效。  (10) 赔偿您承认并同意，您本人应对使用站点和服务时的行为负责，并且您同意，对于因您使用站点和服务、任何客户代表您使用站点和服务或您违反本条款或任何第三方的权利（包括但不限于隐私权）引起第三方索赔或其他事件，进而导致我们可能产生的任何形式的损失、损害、责任、成本或费用（包括但不限于合理的律师费），您将赔偿我们及我们的高级管理人员、董事、员工和代理商，并使我们免受伤害。您在本款项下的义务，应在本条款终止后继续有效。 (11)通信记录除本条款和隐私政策中另有说明外，我们将对与您账户有关的一切个人信息保密。除法律禁止的情况外，您通过站点或电子邮件向我们发送的任何其他通信或材料（包括有关站点和服务的任何意见和建议）均应视为非保密信息，并且我们可将此类通信或材料用于符合我们的隐私政策和本条款的目的，包括复制、发表、传播和发布。如果我们向您提供的任何用户名或密码，是您以服务注册客户的代表身份接收的，则在您与该客户的关系终止后，您不得保留该用户名或密码。您同意，如果知道密码的人从获分配该密码的实体离职，您将立即通知我们。 (12) 开源软件根据本条款纳入软件的特定独立代码，受各种开源或自由软件许可（“开源软件”）的约束。开源软件可不时通过在鸿宝网站发布或向您发出通知的方式进行更新，并根据相应最终用户许可的条款授予许可。本协议任何内容均不得限制您根据此类开源软件适用的最终用户许可所享有的权利，也不得向您授予取代此类许可的权利。本协议的条款（免责和责任限制条款除外）不适用于开源软件。您还同意，在使用任何自由开源软件（"FOSS"，定义见下文）时，不会使软件中的非 FOSS 部分受任何开源软件许可条款或义务的约束。自由开源软件指受一定条款约束的软件，而作为使用、复制、修改或再分发的条件，该等条款要求该软件和/或其衍生作品以源代码形式披露或分发、授予衍生作品制作许可或免费再分发，具体包括但不限于根据 GNU 通用公共许可证、Affero GPL 或 Lesser/Library GPL 分发的软件。 (13)
